Illegal Interview Questions - You Say What?

Are there illegal interview questions an employer can ask during an interview? Yes there are and if the employer chooses to ask them they can face legal implications at the Federal, State, and Civic level. Still, many employers are ignorant of the law or choose to disobey it.

Job interview questions should be focused on what the employer needs to know to make an informed decision when hiring. Are you, based on the qualifications outlined in your resume and the requirements of the job, the "most qualified" candidate? When employers stray from job-related questions to personal ones discrimination issues can become a factor.

The law is clear on specific employment discrimination categories such as race, color, sex, age, and disability. However, employers can circumvent the law by stating the questions are related to the specific performance of the job. Even so, there are illegal interview questions they shouldn't ask. Whatever situation you find yourself in during the interview process it's your decision on whether or not you answer the questions.

What are some of the interview questions that are illegal to ask and how you can handle them?

Any question that deals with your personal life is a question that shouldn't be asked.

* Are you married?
* Are you divorced?
* Do you have a significant other?
* Do you have children?

Politely tell the employer that while you're at work you will devote your time to work, but what happens in your personal life is personal.

You can also ask the employer how the question relates to the job and why they want to know. The work might be such that they want to know if you're committed or capable of working for them. A utility company is a public service company and usually requires their employees to work overtime as required.

Any question that's related to sexual orientation, age, race, physical capability, etc. is illegal to ask in the interview. You do not have to reply to these questions.

* How old are you?
* Do you have any disabilities?
* What's your ethnicity?

It can be a very uncomfortable position to be in when faced with these kinds of questions. Take note of the time, date, names of people present during the interview and be prepared to file a complaint if necessary.

You can obtain up-to-date information on illegal interview questions employers should avoid by contacting your local government office (labor relations) or the Federal Equal Employment Opportunity office. A quick Internet search prior to the interview will reveal the types of questions that are illegal in an interview.

Illegal Interview Questions: How To Handle Them

Legal interview questions come in all shapes in sizes and local employment laws will dicate which ones are illegal. Typically, the following topics are off limits for interviews and are not considered to be legal interview questions:
# Age

# Marital Status

# Information about your spouse or significant other

# Race

# Sexual orientation

# Religion

# Political affiliation

# Country of birth

# Physical disabilities

# Your plans to have children

# Other personal information that does not directly relate to the job

You should only be asked legal interview questions during an interview but let's face it, chances are good that you will run into an interviewer at some point that will ask you one of more of these not-so legal interview questions. You can choose to answer the question(s) in one of three ways:

1. You could choose not to answer the question which will probably ruin your chances at the job.

No, this isn't fair but it is often the reality if you choose this route. I'm not sure I'd want to work for a company that hires managers who treat people this way anyways to be honest.

2. You could choose to answer the question.

In other words, you tell the interviewer the honest answer to the question.

3. You could choose to ignore the question and handle the possible reason for asking such a question.

If for example you were asked your age and you are young, you might respond by saying that you are experienced beyond your years if you suspect the interviewer feels you are too young for the position.

If you are more experienced and feel that the interviewer might believe you to be too old for the position, you might suggest that your experience brings a unique insight to the role that a less experienced candidate couldn't bring.

In other words, you politely let the interviewer know that whatever concern they might have is not a valid one.

One thing to keep in mind when handling these sorts of questions:

Not all interviewers who ask not-so legal interview questions are doing it for insincere reasons.

Interviewers are human, too!

No, it is not right to ask you about your country of origin (for example) but they might be genuinely interested to learn more about you. If you meet someone on the street and are casually talking, it probably wouldn't seem out of the ordinary to ask each other such questions and sometimes it is hard for an interviewer to remember that some questions are simply not ones they should include in an interview setting.

If they are simply trying to make conversation with you, it can be difficult to consistently stick to asking legal interview questions and they might not intentionally mean to do something wrong so be careful how you react to such questions. Use common sense when responding.

Just ensure that you are aware what possible questions you would not feel comfortable answering and be certain that you know how you'll handle each question should one arise.

How to Handle Illegal Interview Questions

When you're applying for a job and get called in for an interview, there are a million things racing through your head. What to wear? How early should I arrive? How should I explain my employment gap? Etcetera, etcetera. With all the things to consider, it probably doesn't even enter your consciousness that the interviewer can ask you an illegal question, but it happens all the time.

Identifying Illegal Questions

It is important to be able to first identify what is legal and what is not, then you can determine what the best way to handle it is. Any question which pertains to the following characteristics is considered illegal because it can be used for discriminatory purposes.

o Age

o Gender

o Marital Status

o Birthplace

o Nationality

o Religion

o Race

o Disability

Employers do not typically ask blatantly discriminatory questions. More frequently, they will mask their intent by rewording the question to seem innocent. Examples of such deviousness include, "how many children do you have?," "what year did you graduate?," or "what is your native language?"

What to Do?

After identifying an illegal question, you are then faced with the decision of what to do. While this can be a very uncomfortable situation, it is important that you do not provide answers to discriminatory questions. No matter how badly you want the job, it is in your best interest to do one of the following options:

Your first option would is to avoid the question and politely change the topic. Your transition does not have to be seamless. In fact, making it apparent that you are intentionally avoiding the interviewer's discriminatory questions can be to your benefit. If they were genuinely curious and did not realize they were asking inappropriate questions, they will quickly adjust and appreciate your cue.

If the interviewer does not catch the hint, and continues to ask inappropriate questions, you have two options. You can either bring it to the interviewer's attention that they are asking discriminatory questions and that you refuse to answer them; or, you can exit the interview.

Regardless of how you handle the scenario, you should consult with an employment lawyer to discuss your legal options. Laws are in place to prevent employers from asking discriminatory interview questions and protect your rights.
